GENERAL TERMS & CONDITIONS

  

NETCHAUFFEURS.COM© is a trademark belonging to CHABE LIMOUSINES.

  

0. TERMINOLOGY

 

The person making a booking on the NETCHAUFFEURS.COM website is referred to as « The Client ».

 

The beneficiary of the transport service is referred to as « The Passenger ».

 

 

I. PRESENTATION OF THE ONLINE SERVICE

 

1.1. NETCHAUFFEURS.COM enables you to book a chauffeur-driven car anywhere in the world *.

 

* You can view a map representing the geographical areas currently covered by the NETCHAUFFEURS.COM service offer.

 

In order to be processed all bookings must be placed at least 24 hours before the transport service is due to start.

 

1.2. NETCHAUFFEURS.COM offers three types of transport services:

 

-          Transfer (Airport/station/city): a transport service whose departure and arrival points are indicated beforehand by the Client;

-          Transport: a transport service comprising several successive transfer operations;

-          Excursion: this transport service enables the Client to explore a tourist region on a set itinerary and programme pre-established by NETCHAUFFEURS.COM.

 

Said transport services are referred to collectively hereinafter as « the transport services ».

 

1.3. For the purpose of the transport services, the Client can choose from three categories of vehicles:

 

-          luxury saloon

-          saloon

-          8-seater minibus



II. GENERAL TERMS & CONDITIONS: APPLICATION & CONTESTABILITY

 

These general terms and conditions of sale define the rights and obligations of the parties in the context of the sale of transport services by CHABE LIMOUSINES to Clients of the NETCHAUFFEURS.COM website.

 

These terms and conditions govern transport services bookings made on the NETCHAUFFEURS.COM website.

 

 

III. BOOKING PROCESS

 

To book one or more transport services on the NETCHAUFFEURS.COM website, the Client is invited to follow the stages of the booking process in order.

 

Ø   Stage one: TRANSPORT SERVICE DEFINITION

 

At this stage, the Client must define his transport service by completing the obligatory fields below:

 

- type of service (transfer; transport; excursion);

- pickup time and date;

- meeting point or flight or train number (if arrival or departure by plane or train);

- destination (if a transfer) or estimated duration of service (if a non-specified transfer);

- number of passengers.

 

Ø   Stage two: ITINERARY CHECK

 

Once the Client has input and validated the information necessary to define the transport service that he wishes to reserve, a geographical map will appear on the computer screen.

 

This map, featuring the departure point and arrival point of the « transfer » service or the various stages of the « transport » or « excursion » services, enables the Client to check his itinerary.

 

Ø   Stage three: VEHICLE CATEGORY SELECTION

 

In this stage, the Client is invited to choose the category of vehicle that he requires. He can click on a category of vehicle to view* the corresponding vehicle and information on its characteristics.

 

* Photographs and texts describing vehicles are not contractual.

 

Once the Client has selected the vehicle category, the final price of the transport service is displayed.

 

A geographical map summarising the itinerary of the ordered service will remain on the screen enabling the Client to check his booking once again.

 

Ø   Stage four: SUMMARY 

 

In this stage, a booking summary is displayed stating:

-          final price of the service;

-          estimated time of the service;

-          estimated mileage of the service;

-          price for extra hours and kilometres*.

 

*The Client is expressly informed that transport service bookings on NETCHAUFFEURS.COM are finalised on payment. All subsequent itinerary changes to services pre-booked online will result in the application of charges for extra hours and kilometres for all extra time and kilometres resulting from the change.

 

Once the Client has read through his booking summary, he can opt to amend his booking or confirm it. If he confirms it, the booking will be added to the shopping cart.

 

The Client can also make a new booking for another trip and/or return trip.

 

Once the Client has made a booking for the required services, he will be invited to confirm and proceed with payment.

 

Ø   Stage five: IDENTIFICATION

 

            - Client identification

 

To confirm his booking, the Client is required to provide his identification details.

 

(i) The Client already has an account

 

If the Client already has a NETCHAUFFEURS.COM account, all he has to do is input his login and his password to connect.

 

Once connected, the Client can view all trips he has already made using NETCHAUFFEURS.COM. If he wishes to book a service which is identical to one he has already had, he simply has to select it (by clicking on the required service) to add it to his shopping cart. Then he simply has to pay for it.

 

(ii) The Client does not have an account

 

If the Client does not have a NETCHAUFFEURS.COM account, he has two options:

 

- he can create a permanent NETCHAUFFEURS.COM account (1)

- he can choose not to create a permanent account (2)


(1) If the Client chooses to create a permanent account, he must go into the « your account » section and enter his « personal » detail: family name, first name, e-mail, address, city, telephone number, login and password.

 

(2) If the Client chooses not to create a permanent account, he will nevertheless be required to identify himself. All information recorded on the NETCHAUFFEURS.COM website shall then be kept until the booked transport service has been completed in full. Once the transport service has been performed, the information shall be deleted.

 

            - passenger identification

 

In the event that the Client is not the beneficiary of the transport service booked on NETCHAUFFEURS.COM, he will be required to identify the passenger, providing his name and telephone number.

 

All information registered for this purpose on the NETCHAUFFEURS.COM website shall then be kept until the booked transport service has been completed in full. Once the transport service has been performed, the information shall be deleted, unless the Client has opened an account with NETCHAUFFEURS.COM.

 

            - acceptance of general terms & conditions of sale

 

Before finalising the booking and making his payment, the Client is required to accept the general terms and conditions of sale published on NETCHAUFFEURS.COM by ticking the « accept general terms & conditions of sale » box.

 

Ø   Stage six: ONLINE PAYMENT

 

After identifying himself and confirming the content of his booking, the Client then confirms it by making his payment.

 

Payment is performed online on the secure OGONE server by bank card (CARTE BLEUE, VISA, MASTERCARD, AMERICAN EXPRESS).

 

Booking of the transport service(s) shall only be confirmed after the corresponding price has been paid.

 

 

IV. BOOKING CONFIRMATION

 

NETCHAUFFEURS.COM systematically confirms the Client’s booking by sending him an Electronic Ticket by e-mail. When the Client is not the beneficiary of the service, an electronic ticket will also be sent to the passenger.

 

An electronic ticket summarising the Client’s booking indicates:

 

-          OGONE payment number (1)

-          NETCHAUFFEURS.COM booking number (2)

-          CHABE LIMOUSINES service booking number (3)

 

(1) The OGONE payment number confirms that the booking has been paid by bank card.

 

(2) The NETCHAUFFEURS.COM booking number enables the Client to return to the NETCHAUFFEURS.COM website to consult his booking even if he does not have a permanent account.

 

(3) The CHABE LIMOUSINES service booking number enables the Client to identify himself when contacting CHABE LIMOUSINES for any reason whatsoever (running late, booking amendment, complaint, cancellation….).

 

 

V. BOOKING AMENDMENT

 

Once it has been paid for, a booking can neither be changed, exchanged, or refunded.

 

Only one change of passenger is possible, on condition that the information is provided to CHABE LIMOUSINES at least twenty-four (24) hours before the start of the transport service.

 

VI. BOOKING CANCELLATION

 

All booking cancellations must be sent by fax, mail, telephone or e-mail to the CHABE LIMOUSINES service whose telephone number is featured on the electronic ticket.

 

Booking cancellation does not grant any entitlement to any refund.

 

 

VII PASSENGER GREETING

 

On arrival at the pickup place, the passenger(s) will be greeted by the driver holding a NETCHAUFFEURS.COM sign indicating the name of the main passenger.

 

 

VIII. NO SHOW

 

8.1. In the event that the passenger fails to show up at the pickup place, the booking shall be automatically be cancelled one (1) hour after the time initially scheduled for the pickup. Cancellation of the service shall not give rise to any entitlement to refund.

 

8.2. In the event that the driver fails to show up at the pickup place at the date and time indicated on his electronic ticket, the passenger shall be entitled to:

 

- obtain a chauffeur-driven car within a maximum of two (2) hours; to do so, he simply has to call NETCHAUFFEURS.COM by dialling the telephone number featured on his electronic ticket;

 

- cancel the booking if the chauffeur has failed to show up within thirty (30) minutes of the pickup time indicated on his electronic ticket and obtain a full refund of the price paid by him or the Client (except if said delay or said no show is due to a case of force majeure as established by case law of the French Courts) within ten (10) working days of his cancellation request.

 

 

 

IX. SIGNATURE OF THE ELECTRONIC TICKET BY THE PASSENGER

 

When the passenger is picked up by the NETCHAUFFEURS.COM chauffeur and prior to all commencement of the transport service, the chauffeur, in possession of a copy of an electronic ticket, shall remind the passenger of the content of the pre-booked service. At the end of the assignment, the passenger shall validate the itinerary of the transport service completed by signing the corresponding electronic ticket.

 

 

X. INFORMATION ON THE CONTENT OF THE TRANSPORT SERVICE PRICE

 

10.1. The « final price » charged is a price which takes into account the quote elements that the Client has input on the NETCHAUFFEURS.COM website. It includes: chauffeur service, fuel and « transported persons » insurance, costs of tolls, car parks and/or parking meters, costs of meals and/or accommodation of the driver(s), VAT or similar tax applicable in virtue of tax regulations on transport services and the valid rate stipulated by the latter.

 

10.2. All changes to quote elements used to establish the « final price » can result in charging another price. For example, increase in journey time and/or distance resulting from changes made by the passenger to the original route, shall give rise to the invoicing of extra hours and/or kilometres in accordance with the price indicated on the Order summary (stage four). On the other hand, no refund shall be made if the final amount of the transport service is less than the pre-paid booking.

 

 

XI. PAYMENT OF NON-BOOKED EXTRA SERVICES

 

All extra services not included in the booking, in particular extra hours, extra mileage, meal and/or accommodation costs of chauffeurs not initially anticipated, shall be invoiced.

 

Once said extra services are performed, NETCHAUFFEURS.COM shall send the Client and the passenger, if they are two separate people, an invoice by e-mail and by standard mail to the addresses of the Client and passenger indicated during the identification process on the NETCHAUFFEURS.COM website.

 

NETCHAUFFEURS.COM invoices are payable within fifteen (15) days of issue in accordance with the following terms:

 

-          Directly on the NETCHAUFFEURS.COM website; to do so simply identify yourself on the website using the NETCHAUFFEURS.COM booking number and make your payment by bank card;

-          By bank transfer to the bank account number featured on the invoice;

-          By cheque, made out to CHABE LIMOUSINES, sent by registered letter with advice of receipt to the address indicated on the invoice.

 

The Client and the passenger, if they are two separate people, shall be jointly and severally liable for payment of invoices for any extra services not booked in advance.

 

Non-payment of sums due within the deadline indicated on the invoice shall result in the application of late interest at a rate equal to five times the statutory interest rate.

XIII. COMPLAINTS

 

In the event of complaint, the Client and/or passenger, if they are two separate people, are invited to contact Customer Services whose contact details are mentioned in article XII of this document.

 

Solely complaints received within eight days of delivery of performance of the transport service shall be valid.

 

 

XIV. TRANSPORTER’S COMMITMENT & LIABILITY

 

Transport services booked via NETCHAUFFEURS.COM shall be performed by a people transport company that holds the licences and/or certificates of aptitude required under regulations governing this type of company and comply with the safety obligations binding all professional transporters vis-à-vis the transported people as well as the responsibilities associated with the management of people transportation vehicles, whether owned or leased by them, in accordance with the regulations of the Country(tries) in which the journeys are performed.

 

 For all trips, NETCHAUFFEURS.COM shall ensure that:

 

(i)                 Recent vehicles in perfect working order and state of cleanliness are used, in compliance with applicable regulations governing the road transport of people using chauffeur-driven vehicles;

(ii)               The chauffeurs assigned to passengers are carefully selected to meet their requirements.

 

 

XV. PERSONAL DATA MANAGEMENT

 

NETCHAUFFEURS.COM undertakes to respect the confidentiality of the personal data communicated by the Client on its website in accordance with the French law on IT & civil liberties n°78-17 of January 06 1978.

 

In this respect, NETCHAUFFEURS.COM undertakes not to disclose to third parties information communicated by the Client on its website and only use it to process his booking.

 

Under the French IT & Civil Liberties law n°78-17 of January 6 1978, the Client has the right to access his file and a right to rectify or delete his personal information by sending his request to the NETCHAUFFEURS.COM Customer Service.

 

 

XVI. APPLICABLE LAW – COMPETENT COURT

 

All disputes relative to the performance of the transport contract or validity and interpretation of these general terms and conditions of sale shall be governed by French law. Any commercial disputes arising shall fall under the jurisdiction of the Commercial Court for CHABE LIMOUSINES’ head office. All other disputes shall, in all cases, be tried through the French Courts.
